JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-05-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in connection with Rail Darbhanga/Sitamadhi GRP DBG (SMI) P.S. Case No. 08 of 2017, registered under Section 370/34 of the Indian Penal Cod and Section 79 of the J.J Act.

The accusation is that, on receiving secret information about carrying the children boarding in train at Stamarhi for Bombay, informant, who is the Sub-Inspector of SSB Sitamarhi along with other officials reached there, where five persons were seen in suspicion condition, who tried to flee away but they were apprehended. Sixteen children were also found there. Both the

Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case mere on suspicion. In fact, the children recovered with the petitioners are co-villagers and they were going to Bombay in relation. It is further submitted that petitioners have no criminal antecedent and are in custody since 04.02.2017.

Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate(Rail), Samastipur, in connection with Rail Darbhanga/Sitamadhi GRP DBG (SMI) P.S.
