ANJANA MISHRA ORAL ORDER 27-03-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Srinagar (Pujaha) P.S. Case No. 81 of 2013 registered for the offences punishable under Sections 376 and 511 of the Indian Penal Code.

Learned counsel for the petitioner submits that informant herself has filed a petition before the Court of Additional District and Sessions Judge, Bettiah, West Champaran

Patna High Court Cr.Misc. No.43700 of 2014 (2) dt.27-03-2015 2/2 stating therein that the allegation levelled as against the petitioner is false as there has been land dispute existed between the parties. In the statement before the Court in A.B.P. No. 02 of 2013, she has stated that because of mere suspicion, she has named the petitioner in the First Information Report.

Considering the aforesaid submissions and on perusal of the Annexure-2, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, Bettiah, West Champaran in connection with Srinagar (Pujaha) P.S. Case No. 81 of 2013 subject to the conditions as laid down under Section 438(2) of the Cr.P.C..
