JUSTICE BIRENDRA KUMAR ORAL ORDER 15-05-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 365, 302 and 201 of the Indian Penal Code.

The FIR was lodged on missing of the son of the informant, aged about 12 years on 31.05.2016 against unknown. The dead body of the victim was found on 01.06.2016. Thereafter investigation started and on 26.07.2016 witnesses stated before the police that the petitioner was seen following the deceased who was being carried by Md. Mansoor.

Submission of the petitioner is that co-accused Md. Ishaque @ Munna has already been allowed bail by a Coordinate Bench of this Court vide order dated 16.02.2017

Patna High Court Cr.Misc. No.15919 of 2017 (3) dt.15-05-2017 2/2 passed in Cr. Misc. No. 55019 of 2016 and allegation against the petitioner is on similar.

Learned counsel for the informant opposed the prayer for bail.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Supaul/successor Court in connection with S. Tr. No. 218 of 2016 arising out of Chhatapur Police Station Case No. 156 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
