The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act as well as Section 307 & other allied sections of the Indian Penal Code.

9.5 liters of country-made liquor has been recovered near Durga Asthan.

It is submitted that nothing has been recovered from the conscious possession of the petitioner and has been made accused only on suspicion.

However, learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail and submitted that petitioner has got one criminal antecedent of similar nature.
