ANJANA MISHRA ORAL ORDER 25-06-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Nanpur P.S. Case No.75 of 2007 for allegedly having committed the offence under Sections 147, 148, 149, 341, 323, 324, 326, 307 and 504 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has been referred to in the F.I.R. as son of Late Niranjan Pandey and the allegation against him is of snatching a sum of Rs.1750/- only. It is further submitted that there is no allegation against this petitioner of assault to the informant Arvind Chaudhary and the allegation of assault is against others. It is submitted that present case has been occasioned

Patna High Court Cr.Misc. No.19965 of 2015 (2) dt.25-06-2015 2/2 because of the fact that the son of Sogarath Pandey was killed earlier and in the said case accused persons were acquitted. The informant was annoyed only because some of the accused persons had deposed in that case leading to acquittal. Considering the aforementioned submissions and also the fact that allegation of assault as against this petitioner has not been made out in the F.I.R. and that the petitioner has got no criminal antecedents, let the above named petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Pupri at Sitamarhi, in connection with Nanpur P.S. Case No.75 of 2007, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
