JUSTICE SANJAY PRIYA ORAL ORDER 20-04-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The Petitioners seek bail in Nawada Town P.S. Case No. 90 of 2017 instituted for the offence under Section(s) 379, 414, 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that petitioners are drivers of the vehicles which were carrying stone chips. The petitioners were carrying the aforesaid stone chips with valid challan which has been annexed in the bail petition but those could not be produced inadvertently before the police. It has further been submitted that other co-accused have

Patna High Court Cr.Misc. No.14581 of 2017 (3) dt.20-04-2017 2/2 already been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 16719 of 2017.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the Petitioners, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 90 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioners.
