JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Siwan Mahila P.S. Case No. 14 of 2019 registered for the offences punishable under Sections 498A, 494 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.

Allegation against the petitioner, who happens to be husband of the informant, is that he subjected the informantwife to cruelty for non-fulfilment of demand of dowry. It appears that earlier the case was compromise and again she was tortured.

Submission of learned counsel for the petitioner is that he has not solemnized second marriage and he is still ready

They have opposed the prayer for anticipatory bail stating that petitioner is in habit of subjecting his wife to cruelty and torture as earlier case was compromised and against she was subjected to assault and torture and apart from that petitioner has married another lady and she has document in support of her contention.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner.

Accordingly, this application is dismissed.
