JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner as well as learned counsel for the State.

In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 304 B/34 of the I.P.C.

Allegedly, Shobha Devi, daughter of the informant married with the petitioner and gave birth of a baby girl and then the accused persons started demanding motorcycle and ultimately she was killed by strangulation.

Submission is of false implication and that the informant after realizing the real fact that the deceased had committed suicide by hanging herself has filed compromise petition in the court below vide Annexure-2. In this case coaccused Chandan Sharma @ Chandar Sahani and Phool Kumari

Patna High Court Cr.Misc. No.42970 of 2014 (2) dt.16-04-2015 2/2 have already been allowed pre-arrest bail vide Cr. Misc. No. 44022 of 2014 by order dated 15.12.2014 by another Bench of this Court and as such the petitioner also deserves sympathetic consideration in view of the compromise petition filed by the informant.

The learned A.P.P. submits that the informant has detracted from the initial version.

In the facts and circumstances as stated above, the petitioner in case of his arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. S.D.J.M. Raxaul at Motihari, East Champaran in Darpa P.S. Case No. 75 of 2013, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
