The petitioner is apprehending arrest in a case registered for the offences punishable under Section 366A/34 of the Indian Penal Code.
The accusation is of kidnapping the minor daughter of the informant. In the statement, recorded under Section 164 of the Cr.P.C., the victim has supported the accusation against this petitioner and claimed to be a minor.
It is submitted by learned counsel for the petitioner that subsequently the informant retracted from the statement made under Section 164 of the Cr. P.C. and filed a petition before the learned court below stating that she is living with the petitioner as his wife.
Patna High Court Cr.Misc. No.10413 of 2015 (2) dt.23-04-2015 2/2 The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Bhargama P.S. Case No.38 of 2013, pending before the Chief Judicial Magistrate, Araria.
With the above observation, this application is, accordingly, disposed off.
