BAJANTHRI ORAL JUDGMENT Date : 17-01-2022 This matter is heard via video conferencing due to circumstances prevailing on account of the COVID-19 Pandemic. In the instant petition, petitioner has prayed for the following reliefs:-
Patna High Court CWJC No.1018 of 2021 dt.17-01-2022 2/3 "For issuance of an appropriate writ and/or direction/directions, order/orders, commanding the respondent-authorities to provide the arrears of salaries as due from May, 1995 to till date and current salaries to the petitioner and other dues, if any with interest thereon or any other relief or reliefs which the petitioner is entitled to."
Short question for consideration is whether the petitioner is entitled for arrears of salaries from May, 1995 or not? In this regard, petitioner has submitted representation on 14.02.2020 (Annexure-1) followed by decision of this Court passed in CWJC Nos. 253 of 2020 and 387 of 2020 decided on 28.09.2020.
The concerned respondent is hereby directed to take note of the aforesaid material and decide whether the petitioner is entitled to arrears of salary or not. The same shall be calculated and disbursed if the petitioner is otherwise eligible. If the petitioner is not eligible necessary speaking order shall be passed and communicated to the petitioner. The above exercise shall be completed within a period of one month from the date or receipt of this order failing which the petitioner is entitled to litigation cost and it is quantified @ Rs. 10,000/- (Ten Thousand). The same shall be paid to the petitioner by the concerned department/organization.
