JUSTICE PRABHAT KUMAR JHA ORAL ORDER 03-07-2015 Nobody appears on behalf of the petitioner. The case is being passed over for last four days even today the prayer for pass over is being made.

The petitioner apprehends his arrest in Phulwarisharif P.S. Case No. 438 of 2014, registered for the offences punishable under Sections 342, 307 read with Section 34 of the Indian Penal Code.

It is alleged that while the informant was going for IdMilan, the petitioner and others having armed with firearms surrounded the informant. There is very specific allegation against the petitioner Mehre Alam Kaifee @ Bikku that he fired which hit on the leg of the informant.

Considering the facts aforesaid, I am not inclined to
