JUSTICE ARVIND SRIVASTAVA ORAL ORDER 16-05-2022 The application with respect to petitioner no. 2 Hassan Ansari and petitioner no. 4 Mariyam Khatoon has already been dismissed as withdrawn vide order dated 11.04.2022. Heard learned counsel for the petitioner nos. 1, 3 and 5 and learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Tarari P.S. Case No. 62 of 2021 registered under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners

Patna High Court CR. MISC. No.50411 of 2021(3) dt.16-05-2022 2/2 submits that petitioners are innocent and have falsely been implicated in the present case. There is case and counter case between the parties. Further submission is that both the parties have sustained injuries in the alleged occurrence. Petitioners have no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner nos. 1, 3 and 5 be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Judicial Magistrate, Ara in connection with Tarari P.S. Case No. 62 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
