====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 16-06-2026 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State.
2. The petitioner apprehends arrest in connection with Nautan P.S. Case No. 63 of 2026 registered for offences under Sections 64, 352, 351(2) & 3(5) of B.N.S.
3. As per the prosecution case, the petitioner is alleged to have committed rape with the victim on a number of occasions.
4. Learned counsel for the petitioner submits that petitioner is quite innocent and has not committed any offence. He submits that it is a case of consensual sex and when the

5. Learned A.P.P. for the State as well as learned counsel for the informant have vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the case and the allegation levelled, I am not inclined to grant anticipatory bail to the petitioner.
7. Accordingly, this application is dismissed.
8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
