Petitioner seeks bail in Special Case No. 144 of 2017 arising out of F. No. NCB/PZU/V/21/2017 registered for the offence punishable under Sections 8/20 of the NDPS Act. Allegation against the petitioner is of recovery of 98 Kg of Ganja.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. The consignment of the courier was in the name of Sumit but Sumit sent petitioner to receive the same. It has been further submitted on behalf of the petitioner that Ganja was recovered from
Patna High Court Cr.Misc. No.24384 of 2018(9) dt.28-08-2018 2/2 Sheokunj Apartment and not from the house of the petitioner. Considering the fact that 98 Kg of Ganja has been recovered from the possession of the petitioner, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.
However, the trial court is directed to expedite the trial of the petitioner and conclude the same within a period of one year from the date of receipt/production of a copy of this order.
