2. The petitioner seeks bail in Dhanaha P.S. Case No. 86 of 2026 registered for the offences under Sections 329(3), 126(2), 109(1), 115(1), 118(1), 352, 3(5) of BNS.

3. The allegation is that the petitioner along with others assaulted the informant. The specific allegation against the petitioner is that he assaulted the informant by means of a spade, causing head injuries. One of the two injuries sustained was grievous in nature, being a lacerated wound on the left parietal region of the head.

4. Learned counsel for the petitioner submits that the dispute arose out of land dispute and there is a case and countercase between the parties.

5. Learned Additional Public Prosecutor for the State

Patna High Court CR. MISC. No. 39306 of 2026(2) dt.17-06-2026 2/2 has vehemently opposed the prayer for bail of the petitioner.

6. The occurrence took place in the backdrop of a land dispute, and there is a case and counter-case between the parties. The petitioner has been in custody since 15.04.2026, which is over two months. Considering all these circumstances, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of concerned learned Judicial Magistrate, 1st Class, Bagaha, West Champaran in connection with Dhanaha P.S. Case No. 86 of 2026.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
