The petitioner seeks bail in Patepur P.S. Case No. 222 of 2020, registered for the offence under Section 392 of the Indian Penal Code.

As per the First Information Report, three unknown miscreants robbed cash of Rs. 38,000/-, a Samsung tablet, finger biometric, Aadhar Card and I-Card from the informant. It is submitted on behalf of petitioner that name of the petitioner was transpired during course of investigation. It is submitted that no looted article has been recovered from the possession of the petitioner and till date, petitioner has not been put on T.I.Parade. Two similarly situated co-accused namely Sonu Kumar (vide order dated 12.08.2021 passed in Cr.Misc.

Patna High Court CR. MISC. No.49817 of 2021(2) dt.24-01-2022 2/2 No. 15876 of 2021) and Pankaj Kumar (vide order dated 15.11.2021 passed in Cr.Misc. No. 21839 of 2021) have already been granted bail. Petitioner is in custody since 18.10.2020. However, learned A.P.P. for the State opposed the bail petition and submitted that the case of the petitioner is distinguishable from the case of aforesaid co-accused inasmuch as the Aadhar Card, papers relating to R.B.L. Company and cash of Rs. 2,000/- of informant were recovered from the house of the petitioner.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
