The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 272, 273/34 of the Indian Penal Code and u/s 30(a) of the Bihar Prohibition and Excise Act.

As per prosecution case, total 32 litres of illicit liquor was recovered from the house of the petitioners. 4.

It is submitted by learned counsel appearing on behalf of the petitioners that no incriminating article has been recovered from the conscious possession of this petitioner. Petitioners have one criminal antecedent of similar nature in which they are on bail as stated in para 3 of the petition. Local

Learned APP for the State has vehemently opposed the bail of the petitioners and submits that there is huge quantity of recovery is made from the house of the petitioners. 6.

Considering the aforesaid facts and circumstances and huge quantity of recovery from the house of these petitioners, the prayer for grant of anticipatory bail to the petitioners are rejected.
