JUSTICE SUDHIR SINGH ORAL ORDER 04-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 498(A) and 494/34 of the Indian Penal Code.
The allegation against the petitioner is of torturing the informant for non fulfillment of additional demand of dowry. On behalf of the petitioner, it has been submitted that the petitioner has got no criminal antecedent. He is ready to keep the informant as his wife with full dignity and honour. It is also submitted that the petitioner is ready to deposit an amount of Rs. 1800/- (eighteen hundred) per month in the court below, which may be released in favour of the informant.
Patna High Court Cr.Misc. No.19774 of 2015 (3) dt.04-09-2015 2/2 On behalf of the State, it has been submitted that the petitioner is named in the FIR and he is the husband of informant.
Considering the aforesaid facts, the petitioner is directed to deposit an amount of Rs. 1800/- (eighteen hundred) per month in the court below, which shall be released in favour of the informant.
Let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Madanpur P.S.Case No. 59 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
