JUSTICE SANJAY PRIYA ORAL ORDER 2/ 02-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State as well as learned counsel for the informant.

The Petitioner seeks bail in Tatarpur P.S. Case No. 76 of 2016 instituted for the offence under Section(s) 366, 366A/34 Indian Penal Code. It is alleged that Neha took the daughter of the informant with her and thereafter she did not return. Statement of the victim girl has been recorded after her recovery, wherein, she has stated that Neha brought her to her grand-mother's house and her mother gave soft-drink to drink. Thereafter, one Tanweer took her to different places as stated in her statement under Section 164 Cr. P. C.

P.C., it appears that there is no specific overt act against the petitioner. It has been submitted that co-accused, Neha, has already been granted bail by a co-ordinate Bench of this Court by order dated 12.01.2017 passed in Cr. Misc. No.723 of 2017. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-VII, Bhagalpur, in connection with Tatarpur P.S. Case No.76 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
