The petitioner, already in custody, seeks bail in connection with Chhatauni P.S.Case No. 218 of 2016 registered under Sections 380, 457 and 411 of the Indian Penal Code. Allegation in brief is that this petitioner committed theft in the wee hours in the informant's house and apprehended by the local people with stolen gas cylinder, mobiles and old watch.

Submission is that some altercation took place between the petitioner and the informant as the petitioner is a tempo driver and he drove the informant to his house and therefore he has been falsely implicated in this case and witness of the seizure list is also the informant and one of his relatives, and the

Having considered the aforesaid facts and circumstances, the petitioner, namely, Jitendra Kumar Paswan, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Chhatauni P.S. Case No. 218 of 2016.
