JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-01-2022 Heard both parties through video conferencing. The petitioner seeks bail in Madhaura P.S. Case No. 26 of 2021, registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code. As per the prosecution case, while the Circle Officer was doing measurement work of land of informant all the four FIR named accused persons including this petitioner and six to eight unknown persons armed with Daab, Farsa, lathi, Danda came and attacked on them. It is alleged that on the order of petitioner, co-accused Satya Prakash Singh assaulted by means of Daab on the head of informant causing head injury. Petitioner is also alleged to have assaulted with lathi on the head of Abhay Singh, as a result of which he became severely injured.

There is land dispute between the parties. As per the injury report, injuries found on the person of Abhay Singh @ Ashutosh Kumar Singh is simple in nature which is attributed to this petitioner. Petitioner is in custody since 13.01.2021.

Counsel for informant vehemently opposed the prayer for bail and submitted that petitioner is order giver and he is alleged to have assaulted Abhay Singh. Moreover, petitioner has got several criminal antecedents.

Considering the facts and circumstances of the case and the fact that there is land dispute between the parties, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Madhaura P.S. Case No. 26 of 2021.
