JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 379 of Indian Penal Code. As per prosecution case, some unknown persons stole the motorcycle of the informant.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Stolen motorcycle has been recovered from bus stand. Petitioner has been made accused in the instant case only on the basis of confessional statement of one co-accused, Ramjani. Petitioner has got clean antecedent.

Considering the aforesaid facts and circumstances, let

No.39542 of 2022(2) dt.23-11-2022 2/2 the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Araria in Raniganj P. S. Case No. 342 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
