The petitioner apprehends his arrest in Mohania P.S. Case No.432 of 2018, registered under Sections 341, 353, 379 and 34 of the Indian Penal Code and under Section 40(1) of the Bihar Minor Mineral Concession Rule, 1972.

The informant alleged that four trucks loaded with sand were intercepted, but some altercation took place and thereafter the owners of the trucks took away the trucks loaded with sand. Petitioner is driver of one of the trucks. It is submitted that the petitioner was carrying sand with permit and petitioner never committed any illegal act. Taking into consideration the facts and nature of allegation made against the petitioner, petitioner, above named,

No.35801 of 2020(2) dt.22-03-2021 2/2 in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Kaimur at Bhabua in connection with Mohania P.S. Case No.432 of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
