The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30(a), 32, 41 and 56 (a) of the Bihar Prohibition and Excise Act, 2016. It is the case of the prosecution that another accused Pawan Das in terms of para no. 41 of the police case diary has made a confessional statement regarding the involvement of the petitioner to the effect that petitioner Jungbahadur Singh is indulged in buying and selling stolen vehicles and the stolen vehicle in question in this case was given by petitioner Jungbahadur Singh to accused Pawan Das. It was recovered from accused Pawan Das by the police official of Rafiganj police station.

No.35456 of 2019(3) dt.07-08-2019 2/2 It has been submitted on behalf of the petitioner that he is innocent, bears no criminal antecedent and has been falsely implicated in the present case. He submits that nothing has been recovered from the conscious possession or from the house of the petitioner.
In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, his payer for anticipatory bail is rejected in connection with Rafiganj P.S. Case No. 23 of 2018 from the court of the learned Judicial Magistrate, 1st Class, Aurangabad. Accordingly, the application is dismissed.
