ANJANA MISHRA ORAL ORDER 25-06-2015 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in connection with Bettiah (Muffassil) P.S. Case No. 35 of 2015 registered for the offences punishable under Section 386 of the Indian Penal Code.

Learned counsel for the petitioners submits that there is admittedly land dispute between the parties and earlier also a case vide Bettiah (Muffaisl) P.S. Case No. 9 of 2015 had been registered by the informant against the petitioner and in response to which petitioner had also registered a case vide Bettiah (Muffassil) P.S. Case No. 10 of 2015 against the informant under Sections 341, 447, 313, 504 and 506 of the Indian Penal Code. It is further submitted that the present first

Patna High Court Cr.Misc. No.19992 of 2015 (2) dt.25-06-2015 information report has been again lodged to the same occurrence embellishing the prosecution version further by making allegation under sections 386 of the Indian Penal Code. Considering the nature of allegation as made out in the first information report and also the fact that there is a history of land dispute between the parties, save and except the case referred to above, it appears that there is no other criminal antecedents against the petitioners, let the petitioners, in the event of their arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties each of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah (Muffasil) P.S. Case No. 35 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C.
