The petitioner has prayed for bail in a case registered for the offence punishable under sections 379, 414, 420/34 of the Indian Penal Code.

As per allegation in the FIR, two persons have exchanged their ATM Cards and out of these two persons, petitioner was apprehended on spot and on search, 25 ATMs card of different banks were recovered.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. No one has complained about the withdrawal of money by using any of the ATMs Card, recovered from the possession of the petitioner. Petitioner is languishing in judicial custody since 11.03.2022.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari, East Champaran in connection with Govindganj P.S. Case No. 92 of 2022.
