JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-07-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 379, 384 and 147 of the Indian Penal Code. It is alleged that the accused persons came variously armed, assaulted the complainant and her husband when petitioner no.1 took away cash, jewellery and other articles and co-accused Md. Nayeem took the thumb impression on two blank papers. It is submitted by learned counsel for the petitioners that
Patna High Court Cr.Misc. No.25573 of 2015 (2) dt.01-07-2015 2/2 the wife of petitioner no.2 lodged Sakra P.S. Case No. 81 of 2012 making accusation under Sections 341, 323, 354 and 504/34 of the IPC against the complainant and her family and thereafter the present complaint has been filed.
The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Complaint Case No. 1188 of 2013 pending in the court of learned JM, 1st Class, Muzaffarpur. Accordingly, the application is disposed of.
