Versus
The State of Bihar .... .... Opposite Party ====================================================== Appearance :
For the Petitioner : Mr. Rakesh Kumar Tiwary, Adv. For the Opposite Party : Mr. Jitendra Kumar Singh, APP 98 ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 01-05-2017 Heard the learned counsel for the petitioner and the State.
This is a petition for grant of regular bail for offences under Sections 341, 323, 304B, 201, 498A and 406 of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act.
The petitioner is husband of the victim-lady. Allegation is that she was done to death within two months of her marriage for non-fulfillment of the dowry demand.
Submission of the petitioner is that in fact soon after marriage the victim fled away from the house, probably for some extra marital relation, which she was maintaining.
The record reveals that charge sheet has already been submitted in this case under Section 304B of the
Patna High Court Cr.Misc. No.11296 of 2017 (4) dt.01-05-2017 2/2 Indian Penal Code.
Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail.
The prayer for bail is refused.
