Petitioner is in custody since 28.12.2016 in connection with Chanpatia P.S. Case No. 226 of 2016 registered under Sections 363, 366(A), 504, 506/34 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case due to village politics. In fact, the victim girl, who is about 17-18 years, is a major as per the Doctor, who has examined the victim, annexure-2. There was love affair between the petitioner and the victim girl and both of them wanted to solemnized marriage and for that purpose the victim girl herself left her house, which is evident from the statement under Section 164 Cr.P.C., which is annexure-3. No case of abduction is made out against the petitioner, who is of clean antecedent, and rotting in
Patna High Court Cr.Misc. No.7497 of 2017 (2) dt.10-03-2017 custody for the last two months.
Considering the nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-5th, Bettiah, West Champaran in connection with Chanpatia P.S. Case No. 226 of 2016.
