ANJANA MISHRA ORAL ORDER 27-03-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Guthni P.S. Case No. 20 of 2014 registered for the offences punishable under Sections 341, 323, 307, 379, 504/34 of the Indian Penal Code and Sections 3 (1) (x) SC/ST Act. Learned counsel for the petitioner submits that the provisions of Section 3 (1) (x) SC/ST Act would not applicable in the present case as admittedly, a perusal of the First Information

Patna High Court Cr.Misc. No.43697 of 2014 (2) dt.27-03-2015 2/2 Report reveals that the occurrence took place in the house of the informant. Furthermore, it is submitted that from perusal of the First Information Report, it is evident that the informant's side came to the house of the petitioner which led to the aforesaid occurrence.

Considering the aforesaid submissions and the nature of allegation, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Guthni P.S. Case No. 20 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.. (Anjana Mishra, J) Jagdish/- U T
