The petitioners being the mother and sisterin-law (Gotani) of the complainant are apprehending their arrest in a case registered for the offences punishable under Section 498(A)/34 of the Indian Penal Code.

The basic accusation is of torture for nonfulfillment of dowry demand. The husband of the informant is already dead.

Learned counsel for the petitioners submits that the petitioners are ready to allow the informant to live in her in-laws house and enjoy her share of property in the matrimonial house.

Considering the present stand of the petitioners, let the petitioners, above named, be

Patna High Court Cr.Misc. No.33723 of 2014 (2) dt.16-02-2015 2 / 2 released on provisional anticipatory bail for one year in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Phulparas P.S. Case No. 256 of 2013 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jhanjharpur, Madhubani,, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

The provisional bail of the petitioners will be confirmed by the learned court below on filing affidavit that they will allow the informant to live in her in-laws house and enjoy her share of property in the matrimonial house. The said affidavit will be transmitted to the concerned police station.

The provisional bail of the petitioners will be confirmed by the learned court below if the petitioners will comply the undertaking given before this Court.
