The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 272/273/308 of the Indian Penal Code and Section 30(a)/41(1) of the Bihar Prohibition and Excise Act.

Recovery of liquor is alleged from the field side. Five persons fled away from the place of recovery. Chowkidar disclosed the name of the petitioner. Petitioner has no criminal antecedent. Similarly situated co-accused have already been granted the privilege of bail by a coordinate Bench of this Court in Cr. Misc. No. 20071 of 2019 on 02.04.2019. In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender

Patna High Court CR. MISC. No.36214 of 2019(2) dt.11-06-2019 2/2 before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise, Siwan in connection with Asaon Police Station Case No. 127 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
