The Petitioner seeks bail in Amba P.S. Case No. 12 of 2017 instituted for the offence under Section(s) 30(a) of the Excise Act.
It is alleged that 1000 sachets of country made liquor each of 200 ML were recovered from a tempo. It is alleged against this petitioner that he was also travelling in the tempo. It has been submitted on behalf of the petitioner that petitioner was merely a passenger of the tempo. It has further been submitted that other co-accused Chandan Kumar has already been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 12801 of 2017.
Patna High Court Cr.Misc. No.9622 of 2017 (2) dt.11-04-2017 2/2 Keeping in view the period spent in custody by the petitioner, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Amba P.S. Case No. 12 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
The petitioner will also file affidavit in the Court below that he will not indulge in such type of activity in future, otherwise his bail bond shall be liable to be cancelled by lower Court.
