====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-05-2021 Heard Mr. Virendra Kumar, the learned Advocate for the petitioners and Md. Aslam Ansari, the learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Bela P.S. Case No. 74 of 2020, instituted for the offences under Sections 341, 342, 323, 354(B) and 504 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that though they have been named in the F.I.R., but the accusation against them is of general and omnibus nature. It has further been submitted that the petitioners are alleged

Patna High Court CR. MISC. No.37482 of 2020(3) dt.26-05-2021 2/3 to have assaulted the prosecution side and there is no injury report on the record. Apart from this, it has also been submitted that the petitioners have been made accused in this case in order to put pressure on them to abandon their house and to leave the village, so that the house can be taken control of. The dispute actually started with a kind of scuffle between the children in which others also participated.

Considering the nature of accusation in the F.I.R. and taking into account that the petitioners have clean antecedents and that they are agnates of the informant, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bela P.S. Case No. 74 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
