2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 30(a)/37(c) of the Bihar Prohibition and Excise Act, 2016.

3. Total 10.44 litres of country made liquor has been recovered from motorcycle of this petitioner.

4. It is submitted that no recovery has been made from conscious possession of this petitioner. No incriminating article has been recovered from conscious possession of this petitioner. Petitioner has got no concern with the seized liquor. Petitioner claims clean antecedents.

5. Learned APP however vehemently opposed the prayer for bail and submitted that liquor has been recovered from motorcycle of this petitioner.

Considering the facts aforesaid and the fact that petitioner is the registered owner of the motorcycle from which the illicit liquor has been recovered, I am not inclined to enlarge the petitioner above-named on anticipatory bail in connection with Daudnagar PS Case No. 320 of 2023. Accordingly, the same is rejected.
