Petitioner is in custody in connection with Durgawati P.S. Case No. 231 of 2016 registered under Sections 304(B), 201/34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, has not committed any offence and has falsely been implicated in this case. In fact, the deceased died due to her own fault at the time of cooking by straw and the deceased was living separately with her husband. There is nothing specific allegation against the petitioner for demand of dowry and no eye witness of the alleged occurrence is there to support the implication of the petitioner in the alleged occurrence. The petitioner is rotting in custody for the last five months. Moreover, co-accused, Harihar Ram
Patna High Court Cr.Misc. No.7747 of 2017 (5) dt.20-04-2017 has already been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 9522 of 2017.
Considering the nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur (Bhabhua) in connection with Durgawati P.S.
