01-03-2017 Heard Sri Prashant Ved Sen, learned counsel assisted by Sri Subhash Chandra Bose, learned counsel for the petitioner and Sri Madan Kumar, learned Addl. Public Prosecutor. This is the 2nd attempt for grant of bail. Earlier, on 13-07-2016, the prayer for bail of petitioner was rejected, vide Cr. Misc. No. 26813 of 2016, primarily on the ground that there was allegation against the petitioner of firing in Sheikhpura (Kushumbha) P.S. Case No. 209 of 2015 registered for offence under Sections 302, 34 of the Indian Penal Code and Section 27 of the Arms Act, 1959.
Earlier, a report was called for from the court below, which has been received and kept at flag 'A'. The report indicates that after order of cognizance, the case is pending for appearance
Patna High Court Cr.Misc. No.6099 of 2017 (3) dt.01-03-2017 2/2 and commitment.
Considering the facts and circumstances, I do not find any ground to review my earlier order.
The prayer for bail again stands rejected.
