The petitioner seeks bail in Jhanjharpur P.S. Case No. 6 of 2018 registered under Sections 413, 414 and 401 of the Indian Penal Code.
Co-accused Ram Sevak Yadav was arrested along with stolen motorcycle who has named the petitioner involved in the occurrence and on the basis of the aforesaid confessional statement, petitioner was apprehended and stolen motorcycle was recovered from his possession.
It is submitted by learned counsel for the petitioner that the petitioner is quite innocent. He has been falsely implicated
Patna High Court Cr.Misc. No.19034 of 2018 (3) dt.18-05-2018 2/2 in this case by the highhandedness of the police. No incriminating article has been recovered from his conscious physical possession. He has no concern with the aforesaid occurrence. By filing Annexure-2 series, he has submitted that Mukhiya, Sarpanch, and ward member of his Gram Panchayat have unanimously stated that the police picked up the petitioner from his house on the pretext of his interrogation and did not leave him and nothing was recovered from his house at that time. The petitioner has been languishing in custody since 08.01.2018.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani in connection with Jhanjharpur P.S. Case No. 06 of 2018 corresponding to G.R. No. 19 of 2018.
