The petitioner seeks bail in Barauni Rail P.S. Case No. 62/2015, registered for the offences punishable under Sections 302, 34 of the Indian Penal Code and section 27 of the Arms Act. Learned counsel for the petitioner submits that prayer for bail of the petitioner was firstly rejected on 16.01.2017 vide order passed in Cr. Misc. 46683/2016 on the ground that similarly situated co-accused Khiran Singh has already been enlarged on bail vide order dated 04.10.2016 passed in Cr. Misc. 43876/2016. The petitioner again moved before this court after more than six months. Prayer for bail of the petitioner was earlier rejected on the ground that petitioner had moved before this court only after three

Considering the facts aforesaid and the fact that similarly situated co-accused has already been enlarged on bail and the petitioner has already remained in jail for more than one year, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Barauni, Begusarai in connection with Barauni Rail P.S. Case No. 62/2015.
