2. The petitioner apprehends his arrest in a case registered for the offence under Section 30(a)/41(1) of Bihar Prohibition and Excise Act.

3. As per F.I.R., 37.5 liters of illicit foreign liquor has been recovered from an open place and the apprehended coaccused Sikandar Yadav disclosed the name of petitioner, as the person, who fled away from the spot.

4. Learned counsel for the petitioner submits that no incriminating article has been recovered from possession of this petitioner and has been implicated in this case only on confession of co-accused. Petitioner has got one criminal antecedent of similar nature, in which, he is on bail.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts & circumstances of the case, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise - I, Bettiah, West Champaran in connection with Nautan P.S. Case No. 244/2024, subject to condition as laid down under Section 482(2) of the B.N.S.S., 2023.
