Petitioner is in custody in connection with Rosera P.S. Case No. 55 of 2018 for the offence under sections 30(a), 3(d), 38 and 47 of the Bihar Prohibition Excise Act, 2016. Learned counsel for the petitioner submits that petitioner has clean antecedent. He is in custody since 28.2.2018.
Counsel for the petitioner submits that petitioner is one of the seven accused named in the FIR. He submits that out of the seven except this petitioner others have been granted bail. Counsel for the petitioner submits that Banarasi Saw was granted bail in Cr. Misc. No. 21003 of 2018 vide order dated 16.4.2018. He submits that similarly circumstanced other co-accused have been granted bail.
Considering the aforesaid, let the petitioner, named
Patna High Court Cr.Misc. No.19089 of 2018(3) dt.30-04-2018 2/2 above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions JudgeIIIrd cum Special Judge, Excise, Samastipur, in connection with Rosera P.S.
