Petitioner in the present case is seeking regular bail in connection with S. TR. No. 502 of 2017 arising out of Uphara P.S. Case No. 33 of 2016 registered for the offences punishable under Sections 304(B), 379 and 34 of the Indian Penal Code. Earlier the prayer for regular bail of the petitioner was rejected twice vide order dated 19.08.2017 passed in Cr. Misc. No. 38546 of 2017 and order dated 27.08.2018 passed in Cr. Misc. No. 43063 of 2018.

A report has been received from the Superintendent of Police, Aurangabad in compliance of the earlier order dated 24.02.2021.

Patna High Court CR. MISC. No.1863 of 2021(4) dt.15-03-2021 2/2 Having regard to the facts and circumstances of the case and the report of the Superintendent of Police, Aurangabad kept at Flag - 'T', this Court having noticed that now the case is fixed for defence evidence and is likely to be concluded very soon, is not inclined to grant bail to the petitioner. Let the trial court conclude the trial within a period of four months from the date of receipt/production of a copy of this order.

If the trial remains unconcluded for no reason attributable to the petitioner, he may renew his prayer for bail after four months.
