The petitioner apprehends his arrest in connection with Minapur P.S. Case No. 198 of 2020 for the offence punishable under Sections 302/34 of the I.P.C lodged on 03.06.2020 by the informant Sikandar Paswan.

The petitioner is the husband of the victim lady, who is now no more.

It is the submission of the learned counsel for the petitioner that the couple was blessed with three children and the statement of none of them were recorded, the death occurred due to hanging and there is statement of the informant that he has wrongly implicated the son-in-law.

Patna High Court CR. MISC. No.40676 of 2023(2) dt.28-07-2023 2/2 Be that as it may, the matter is of the year 2020 and 3 years later, the petitioner has moved for grant of anticipatory bail which this Court deems it not fit and proper to allow and the same is accordingly rejected.

The petitioner, if so advised, can surrender before the Court below, who shall take into account the aforesaid submission put forward by the learned counsel for the petitioner and dispose of the bail application on the same day without being prejudiced by any of the observation made herein.
