Petitioner seeks bail in connection with Tajpur (Vaine O.P.) P.S. Case No. 255 of 2017 registered for the offence punishable under sections 324, 326, 307,/34, 120B of the Indian Penal Code and section 27 of the Arms Act. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. Petitioner is in custody since 10.09.2017.

Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner is

Patna High Court CR. MISC. No.36126 of 2019(4) dt.13-09-2019 2/2 named in the first information report and there is direct allegation of firing against him.

Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of bail to the petitioner. The same is, therefore, rejected.
