This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 376 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Learned counsel appearing on behalf of the petitioners, referring to the First Information Report, contends that no offence under Section 376 of the Indian Penal Code is made out on the basis of the allegation contained therein. I find substance in the submission made on behalf of
Patna High Court Cr.Misc. No.19536 of 2015 (2) dt.09-07-2015 2/2 the petitioners.
This application is allowed.
Let the petitioners above named, in the event of their arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No. 87 of 2009, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
