ANJANA MISHRA ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State. Petitioner apprehends arrest in connection with Complaint Case No. 1153(C ) of 2014 in which cognizance has been taken for the offences punishable under sections 323, 354, 354-A and 509 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a responsible Panchayat Secretary and in due discharge of his duties he had tried to obtain certain documents from the complainant which was being resisted by her. He further submits that the entire case against the petitioner is malicious and

Patna High Court Cr.Misc. No.19863 of 2015 (4) dt.01-10-2015 has been occasioned on account of local politics. Considering the fact that in spite of service of notice on the complainant-opposite party, she has chosen not to appear before this Court and contest the matter and also because the petitioner has got no criminal antecedent, petitioner above named, in the event of arrest or surrender in the court below within three weeks from the date of receipt/production of a copy of this order, shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, IInd Class, Munger in Complaint Case No. 1153(C ) of 2014 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973.
