Petitioner, already in custody, seeks bail in connection with Patna Junction Rail PS Case No.579 of 2017, registered under Sections 370 and 374/34 of the Indian Penal Code, Section 14 of the Child Labour (Prohibition and Regulation) Act, 1986, Section 26 of the Juvenile Justice Act as well as under Section 17 of the Bonded Labour System (Abolition) Act, 1976.
Allegation is that the petitioner was taking away 10 children for engaging them as labour in the State of Maharashtra on the prestext of getting them admitted in Madarsa. Learned counsel for the petitioner submits that the children were taken by the petitioner for their admission in a
Patna High Court Cr.Misc. No.14882 of 2018(3) dt.07-05-2018 2/2 Madarsa in the State of Maharashtra and that the same is also reflected from their statements recorded by the police during investigation contained in the case diary, so only suspicion is raised and the petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances, petitioner Md. Must Hussan @ Must Hasan is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Railway, Patna in connection with Patna Junction Rail PS Case No.579 of 2017.
