This is a petition for grant of regular bail for offences under Sections 272 and 273 of the Indian Penal Code and 30(i), 36 and 41 of the Bihar Prohibition and Excise Act, 2016.

Huge quantity of foreign liquor was recovered from the pick-up van. The driver of the van disclosed the name of co-accused, Kamlesh Yadav, thereafter, on raid, from the house of Kamlesh Yadav, foreign liquor was recovered and Kamlesh Yadav disclosed the name of the petitioner as an accused.

The petitioners have stated on oath that they have got no criminal antecedent and nothing has been recovered from the house of the petitioners. The petitioners are in custody since 23.12.2016.

No.8357 of 2017 (3) dt.18-03-2017 2/2 Considering the aforesaid fact, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Madhubani Town P.S. Case No. 352 of 2016 to the satisfaction of the Chief Judicial Magistrate, Madhubani, or successor Court with the condition that the petitioners shall fully cooperate with the investigation/trial of the case and if the Court below would come to notice that the petitioners have committed similar type of offence in future, the Court below shall be at liberty to cancel the bail bond of the petitioners in this case also.
