The matter has been listed at the instance of the petitioner to correct certain factual mistakes which crept inadvertently in the order dated 30.07.2015.

The counsel draws attention of the Court to paragraph 1(i) as also annexure 2 of the writ application in order to submit that a proceeding before the District Certificate Officer for recovery of Rs. 3,74,875/- was instituted against the respondentBank inasmuch as warrant was also issued. The Bank actually did not pursue the matter.

Consequently, paragraph 1(i) at page 2 of the writ application is substituted by the following:- "On the request made by the petitioner the respondent-Bank extended him the privilege of

Patna High Court CWJC No.7056 of 2015 (6) dt.04-08-2015 2/2 cash credit and debit on certain amounts thereagainst. Subsequently, a proceeding was also filed before the respondent-Certificate Officer, Chapra for recovery of a sum of Rs.

3,74,875/- from the respondent-Bank to be paid to the petitioner wherein notice was issued to the respondent-Bank. The Bank did not pursue the matter and, as such, warrant was also issued."

The order dated 30.07.2015 is modified/clarified to the extent indicated above.
