JUSTICE SANJAY PRIYA ORAL ORDER 18-05-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Kauakol P.S. Case No. 158 of 2016 instituted for the offence under Section 376 of the Indian Penal Code.
As per written report of the informant Rekha Kumari aged about 14 years, this petitioner took her inside the room and committed illegal act with her.
The victim girl in her statement under Section 164 Cr. P.C. which is annexed as Annexure-2 has mentioned her age to be 14 years but the court below has assessed her age to be 15 years. She has levelled specific allegation against the petitioner of committing illegal act with her. She is suffering from polio and when she tried to raise hulla, this petitioner shut her mouth with
Patna High Court Cr.Misc. No.18515 of 2017 (2) dt.18-05-2017 2/2 towel.
Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and pray for regular bail.
